Minutes of the Regular Meeting

Held August 13, 2018 at the Town Hall Commencing at 7:30 P.M.

Supervisor Anderson opened the regular Town Board meeting at 7:30 with the Pledge of Allegiance.

Resolution 2018-68 Approval of Minutes

A motion was made by Councilor Greenway and seconded by Councilor Behling to accept the following resolution. The motion was adopted by a vote of 4 ayes, Anderson, Behling, Greenway, Barber, 0 nays and Partrick abstained.

Resolved the Mexico Town Board approves the minutes from the July 9, 2018 town board meeting.

Communications:

Reports:

Town Clerk – A motion was made by Councilor Partrick and seconded by Councilor Barber to accept the town clerk report as presented.  The motion was adopted by a vote of 5 ayes, Anderson, Behling, Greenway, Barber, Partrick and 0 nays.

 Dog Control Officer– A motion was made by Councilor Behling and seconded by Councilor Greenway to accept the monthly report as presented.  The motion was adopted by a vote of 5 ayes, Anderson, Behling, Greenway, Barber, Partrick and 0 nays.

Zoning Officer / Building Inspector – A motion was made by Councilor Behling and seconded by Councilor Greenway to accept the monthly report as presented.  The motion was adopted by a vote of 5 ayes, Anderson, Behling, Greenway, Barber, Partrick and 0 nays.

Highway Superintendent – A motion was made by Councilor Greenway and seconded by Councilor Partrick to accept the monthly report as presented.  The motion was adopted by a vote of 5 ayes, Anderson, Behling, Greenway, Barber, Partrick and 0 nays.

Community Park – none

Mexico Point Park – Anderson said he and Partrick were meeting with the Friends of Mexico and were making progress.  Barber said he was meeting with Joe Maryak about renovations to Casey’s Cottage.

Water Commissioner –A motion was made by Councilor Greenway and seconded by Councilor Barber to accept the monthly report as presented.  The motion was adopted by a vote of 5 ayes, Anderson, Behling, Greenway, Barber, Partrick and 0 nays.

Supervisor A motion was made by Councilor Greenway and seconded by Councilor Partrick to approve the supervisor’s report as presented.  The motion was adopted by a vote of 5 ayes, Anderson, Greenway, Behling, Barber, Partrick and 0 nays.

Supervisor Anderson said the audit report would be available next month.

Assessor – Maxwell said Tops and Wilkinson have claims against the town.  A motion was made by Councilor Behling and seconded by Councilor Barber to approve the assessor’s report as presented.  The motion was adopted by a vote of 5 ayes, Anderson, Greenway, Behling, Barber, Partrick and 0 nays

Resolution 2018- 69 June Payroll

A motion was made by Councilor Greenway and seconded by Councilor Barber to accept the following resolution.  The motion was adopted by a vote of 5 ayes, Greenway, Behling, Barber, Partrick, Anderson and 0 nays.

Resolved the Mexico Town Board approves the June payroll.

Resolution 2018- 70 July Payroll

A motion was made by Councilor Greenway and seconded by Councilor Barber to accept the following resolution.  The motion was adopted by a vote of 5 ayes, Greenway, Behling, Barber, Partrick, Anderson and 0 nays.

Resolved the Mexico Town Board approves the July payroll.

Water Update – Ian Yerdon said the survey went out last month.  Anderson asked when the EDU charge would appear on the tax bills.  Yerdon said either in 2019 or 2020.  He would consult with Guminiak.  Dishaw said there were still several people that did not get questionnaires. Yerdon said they only sent them to people who did not get a questionnaire in 2014.  Greenway said it was her understanding that all people not receiving water would get a questionnaire.

Resolution 2018-71 Water Questionnaires

A motion was made by Councilor Partrick and seconded by Councilor Greenway to accept the following resolution.  The motion was adopted by a vote of 5 ayes, Anderson, Greenway, Behling, Barber, Partrick and 0 nays.

Resolved the Mexico Town Board approves a questionnaires sent to areas not serviced by water that were previously sent in 2014.

Resolution 2018-72 Right of Way Agreement

Geraldine Dawson said she needs to make repairs to a small area of riprap and asked permission to use the right of way owned by the town.  Anderson asked about the bollards being painted blue.  Dawson said the paint was chipping so she and her husband painted them.  Anderson asked if Dawson had permission from the highway department or town to repaint the bollards.  She said no.  Anderson said the bollards are hard to see by bus drivers turning around in bad weather and should be painted yellow.  Anderson asked if she would pay legal expenses for a contract to use the right of way and the cost to repaint the bollards.  Dawson agreed.

A motion was made by Councilor Greenway and seconded by Councilor Behling to accept the following resolution.  The motion was adopted by a vote of 5 ayes, Anderson, Greenway, Behling, Barber, Partrick and 0 nays.

Resolved the Mexico Town Board authorize Nelson Law to draw up a contract between Geraldine Dawson and the town allowing her to use the right of way until October.  Dawson would pay all legal fees and the cost of repainting the bollards.

Anderson reviewed the recommendations by NYMIR.  A copy was given to the highway superintendent.

Resolution 2018-73 Repairs to Steps and Ramp

A motion was made by Councilor Barber and seconded by Councilor Behling to approve the following resolution.  The motion was adopted by a vote of 5 ayes, Anderson, Greenway, Behling, Barber, Partrick and 0 nays.

Resolved the Mexico Town Board approves the quote for the steps and sidewalk repairs by Don Austin with the substitution of granite used as the curbing material near the assessor’s entrance.

Resolution 2018-74 Highway Conference

A motion was made by Councilor Greenway and seconded by Councilor Behling to approve the following resolution.  The motion was adopted by a vote of 5 ayes, Anderson, Greenway, Behling, Barber, Partrick and 0 nays.

Resolved the Mexico Town Board approves the attendance of the highway superintendent to attend the training at Turning Stone.

A motion was made by Councilor Greenway and seconded by Councilor Behling to go into executive session to discuss litigation at 8:08.  The motion was adopted by a vote of 5 ayes, Anderson, Behling, Greenway, Barber, Partrick and 0 nays.   Executive session was closed at 8:17.

 Resolution 2018-75 Litigation

A motion was made by Councilor Partrick and seconded by Councilor Greenway to accept the following resolution.  The motion was adopted by 5 ayes, Anderson, Greenway, Behling, Barber, Partrick, and 0 nays.

Resolved the Mexico Town Board authorizes Nelson Law Firm to contact Tops Market pertain to litigation.

 Resolution 2018 76 Audit of Claims 

A motion was made by Councilor Behling and seconded by Council Partrick to accept the following resolution.  The motion was adopted by a vote of 4 ayes, Anderson, Behling, Barber, Partrick, 0 nays and Greenway abstained.

Resolved that the bills for Abstract 8 have been reviewed by the Town Board and are authorized for payment in the following amounts:

General A Fund                      voucher # 201 to 227              $    107,421.30

General B Fund                      voucher # 63 to 71                  $        4,904.66

Highway Fund                        voucher # 160 to 197              $    512,975.59

Water                                      voucher # 14 to 15                  $      22,236.75

Special Districts                      voucher # 12                           $           320.70

Greenway asked what was wrong with the clock at McAuslan Hall.  Behling said something needed to be repaired.

A motion was made by Councilor Partrick and seconded by Councilor Barber to accept the following resolution.  The motion was adopted by a vote of 5 ayes, Anderson, Greenway, Behling, Barber, Partrick and 0 nays.

Resolved the Mexico Town Board approves the use of McAuslan Hall by the Mexico Historical Society to be used as an alternate location for the 225th Starr Clark Birthday Celebration if needed.

Will and Trish Dupra asked Greenway if there were any photos of the school at Lamb’s Corners.  Greenway said yes.

A motion was made by Councilor Partrick and seconded by Councilor Greenway at 8:30 to adjourn.  The motion was adopted by a vote of 5 ayes Anderson, Greenway, Behling, Barber, Partrick and 0 nays.
