Supervisor Anderson opened the regular Town Board meeting at 7:30 with the Pledge of Allegiance.  

            Resolution 2019-120 Approval of Minutes

A motion was made by Councilor Greenway and seconded by Councilor Partrick to accept the following resolution.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.

Resolved the Mexico Town Board approves the minutes from the November 11, 2019 town board meeting.

Public Comment and Concerns:  Concerns were the Little League not allowing a child to pay ball and refusing to issue a waiver for them to play elsewhere, the lawsuit between the county and Town of Mexico, the number of employees at highway department and number of miles on county roads.

Reports:

 Town Clerk/ Tax Collector/ Water Clerk- A motion was made by Councilor Partrick and seconded by Councilor Behling to accept the town clerk/water clerk report as presented.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and 0 nays.

Dog Control Officer- A motion was made by Supervisor Anderson and seconded by Councilor Partrick to accept the dog control report as presented.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.   Attorney Prosachik said she was finalizing the order for contempt toward the owner of the dangerous dog.

Zoning Officer / Building Inspector– Marsden suggested revaluating the fee schedule.  A motion was made by Councilor Partrick and seconded by Councilor Behling to accept the monthly report as presented.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays. C

Community Park –none

Mexico Point Park –Bond said the roof is complete.  The closed signs are up.  She is telling people with reservations that the rip rap may cause a problem with reservations.  Partrick said the installation of the rip rap should not interfere with the pavilion and Casey’s Cottage.  Partrick suggested Bond notify people in writing that heavy equipment may be the backdrop in some photos.  Chepko-Sade suggested putting on the website.  A motion was made by Councilor Partrick and seconded by Councilor Behling to accept the monthly report as presented.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.

Water Commissioner –Grimshaw said one of the two fire hydrants hit have been repaired.  The UPFO’s for water district #5 have been done.  Barber asked if the reports Grimshaw submitted for the UFPO’s was done on the software he recommended for the highway.  Grimshaw said yes.  Behling asked who puts in the data.  Grimshaw said Powers.  A motion was made by Councilor Greenway and seconded by Councilor Partrick to accept the monthly report as presented.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.

Planning and Zoning Weber said she would like to have the minutes of the Planning and Zoning Board on the website.  Weber suggested the town contact the Amish Bishop about enforcing rules for safety of buggies.  .  The number of sawmills are increasing in Mexico, the updating of the Comprehensive Plan should address the issue.  Waterbury said a special permit was approved for another sawmill.  A motion was made by Councilor Partrick and seconded by Councilor Behling to approve the reports as presented.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.

Supervisor A motion was made by Councilor Behling and seconded by Councilor Greenway to approve the supervisor’s report as presented.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.

             Resolution 2019- 121 November Payroll

             A motion was made by Councilor Greenway and seconded by Councilor Behling to accept the following resolution.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.
Resolved the Mexico Town Board approves the November payroll.

Water Update –Water District #5 construction has begun.  The increase in EDU’s to include Rice Rd in WD#6 would be $10 per EDU.  Barber asked how many feet of pipe would it take to complete the entire town.  Yerdon said the funding agencies will not fund large project.  The first pay draw is complete for Highlanders. 

             Resolution 2019- 122 Water District # 5 Pay Application

             A motion was made by Councilor Greenway and seconded by Councilor Barber to accept the following resolution.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.
Resolved the Mexico Town Board approves the Water District #5 pay application for Highlanders in the amount of $627,572.52.

             Resolution 2019- 123Water District # 6 Amendment

             A motion was made by Councilor Greenway and seconded by Councilor Partrick to accept the following resolution.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.
Resolved the Mexico Town Board approves the amendment to the C2AE contact for $1,200 to include Rice Road in Water District #6.

             Resolution 2019- 124 Appoint Electronic Banking Representative

             A motion was made by Councilor Greenway and seconded by Councilor Behling to accept the following resolution.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.
Resolved the Mexico Town Board appoints Clerk to the Supervisor Kathy Barber as the electronic banking representative.

Resolution 2019- 125 Dog Control Cell Phone

A motion was made by Councilor Behling and seconded by Councilor Greenway to accept the following resolution. The motion was adopted by 4 ayes; Anderson, Greenway, Barber, Partrick and 0 Nays.
Resolved the Mexico Town Board approves the purchase of a new cell phone for Dog Control Officer Jack Spriggs to replace the old phone.

             Resolution 2019- 126 Items to Auction

 A motion was made by Councilor Behling and seconded by Councilor Barber to accept the following resolution.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.
Resolved the Mexico Town Board authorizes highway superintendent to auction unused highway equipment on Auctions International.

             Resolution 2019- 127 Resolution 2018-127 Post Highway Roads

A motion made by Councilor Greenway and seconded by Councilor Behling to accept the following resolution.  The motion was adopted by a vote of 5 ayes, Anderson, Behling, Greenway, Barber, Partrick and 0 nays.
Resolved the Mexico Town Board authorizes the highway superintendent to post the town roads for no parking from December 1st to April 1st.

Anderson said he met with the Historical Society, Prosachik and Tim Fennel to discuss the inventory of the museum.  Greenway will research inventory companies.

             Resolution 2019-128 Prepayments on Abstracts

A motion was made by Councilor Partrick and seconded by Councilor Behling to accept the following resolution.  The motion was adopted by 5 ayes, Anderson, Behling, Barber, Greenway, Partrick and 0 nays.
WHEREAS, National Grid bills arrive after the Town Board Meeting on occasion as do some others.
WHEREAS, to avoid late fees on bills that are not on the monthly abstract there is a need to prepay these bills.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Mexico hereby authorizes the Deputy to the Supervisor to prepay such bills with the approval of the Town Supervisor.

             Resolution 2019- 129 Official Undertaking Form

A motion was made by Supervisor Anderson and seconded by Councilor Partrick to accept the following resolution.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.

Resolution 2019-130 Schedule the Year-End Meeting

A motion was made by Supervisor Anderson and seconded by Councilor Greenway to accept the following resolution. The motion was adopted by 5 ayes; Anderson, Behling, Greenway, Barber, Partrick and 0 Nays.
Resolved the Mexico Town Board schedules the year-end meeting for December 27, 2019 at 7:00, 64 South Jefferson Street, Mexico, New York 13114.

             Resolution 2019- 131 Local Law 1 of 2019 Override the Tax Cap

 A motion was made by Councilor Partrick and seconded by Councilor Behling to accept the following resolution.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.
Resolved the Mexico Town Board approves Local Law #1 of 2019 to override the Tax Cap.

             Resolution 2019- 132 Poor House Cemetery

A motion was made by Councilor Greenway and seconded by Supervisor Anderson to accept the following resolution.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.
Resolved the Mexico Town Board authorizes Attorney Prosachik to review the state laws for the Town of Mexico to take out the abandoned cemetery on County Route 64commonly known as the Poor House Cemetery.

There was a discussion on Gracie Battles not allowed to play Little League.

Prosachik said she was currently drafting the IMA for the Highway Shoulder Machine Shared Services with Richland and six other towns.

There was a discussion on the highway software.  Barber said he would like to get the software for the highway.  Partrick said he would be willing to meet with the village to review the software.  Anderson said not to violate the open meeting law.  Behling said the reports contain a lot of information.  Marsden said he would not going to use the software.  Marsden said “Point Blank I’m not doing it.”

             Resolution 2019-133 Audit of Claims 

A motion was made by Councilor Greenway and seconded by Supervisor Anderson to accept the following resolution.  The motion was adopted by a vote of 5 ayes Anderson, Behling, Barber, Greenway and Partrick and 0 nays.
Resolved that the bills for Abstract 12 have been reviewed by the Town Board and are authorized for payment in the following amounts:
