Supervisor Anderson opened the regular Town Board meeting at 7:30 with the Pledge of Allegiance.

Resolution 2015-85 Approval of Minutes
     On motion by Councilor Greenway and seconded by Councilor Behling the following resolution was adopted by a vote of 5 ayes, Anderson,  Greenway, Behling, Barber, Partrick and 0 Nays
Resolved the Mexico Town Board approves the minutes from the September 10, 2015 town board meeting.

Communications:

  1. Oswego County Highway Dept. – Snow & Ice Agreement
  2. NYS Ag & Market – Dog Control Inspection Report

Public Comment and Concerns:
Concerns from residents were collapsed barn on Dewey Rd, fire hydrants and selling lumber on Cole Rd.

Reports:
Town Clerk:  A motion was made by Councilor Behling and seconded by Councilor Greenway to accept the monthly report as presented.  The motion was unanimously adopted by 5 ayes:  Anderson, Greenway, Behling, Barber, Partrick and 0 nays.
Dog Control Officer:  A motion was made by Councilor Behling and seconded by Councilor Barber to accept the monthly report as presented.  The motion was adopted by 5 ayes:  Anderson, Greenway, Behling, Barber, Partrick and 0 nays.
Zoning Officer / Building Inspector:  A motion was made by Councilor Behling and seconded by Councilor Barber to accept the monthly report as read.  The motion was adopted by 5 ayes:  Anderson, Greenway, Behling, Barber, Partrick and 0 nays.
Highway Superintendent:  A motion was made by Councilor Barber and seconded by Councilor Behling to accept the monthly report as read.  The motion was adopted by 5 ayes:  Anderson, Greenway, Behling, Barber, Partrick and 0 nays.
Community Park:  Soccer, football and baseball have been ongoing.  There were 44 reservations for the pavilion.  A motion was made by Councilor Greenway and seconded by Councilor Barber to accept the monthly report as read.  The motion was adopted by 5 ayes:  Anderson, Greenway, Behling, Barber, Partrick and 0 nays.
Mexico Point Park:  None
Supervisor:  A motion was made by Councilor Barber and seconded by Councilor Behling to accept the monthly report as read.  The motion was adopted by 5 ayes:  Anderson, Greenway, Behling, Barber, Partrick and 0 nays.

Resolution 2015-86 Payroll
     On a motion by Councilor Greenway and seconded by Councilor Behling the following resolution was adopted by 5 ayes; Anderson, Greenway, Behling, Barber, Partrick and 0 nays.
Resolved the Mexico Town Board approves the September payroll.
Water UpdateWater district #3 is moving along.  There was a problem boring under the road for a water installation.
Justice Audit – Councilor Barber said he would get it done.
Supervisor Anderson told the board the 3rd Quarterly Report was for the board’s review.
There was a short discussion on the budget.   There will be no budget workshop.

Resolution 2014-87 Schedule Public Hearing for Budget, Fire and Ambulance
     A motion was made by Councilor Behling and seconded by Councilor Greenway to accept the following resolution. The motion was adopted by 5 ayes; Anderson, Greenway, Behling, Barber, Partrick and 0 nays.
Resolved the Mexico Town Board scheduled a Public Hearing for November 5, 2015 at 7:30 pm for the Budget, 7:40 pm for the Fire Contract, and 7:50 pm for the Ambulance Contract at the Town Hall, 64 South Jefferson Street, Mexico, NY 13114.

Resolution 2015-88 ESTABLISHING A CAPITAL RESERVE FUND
     On a motion by Councilor Behling and seconded by Councilor Greenway the following resolution was adopted by 5 ayes; Anderson, Greenway, Behling, Barber, Partrick and 0 nays.
     WHEREAS, the Town Board has identified that the Town of Mexico owns several municipal buildings which will require repairs, and other capital improvements in the future; and
     WHEREAS, the Town Board deems it in the best interests of the Town to establish a capital reserve fund to finance repairs and other capital improvements for its buildings; and
            NOW, THEREFORE, on motion made by Behling and seconded by Greenway BE IT RESOLVED as follows:

  1. That pursuant to Section 6-c of the General Municipal Law, as amended, there is hereby established a capital reserve fund to be known as the Town of Mexico Building Repair Reserve Fund. The purpose of this Reserve Fund is to accumulate money to finance the cost of a type of capital improvement. The type of capital improvement to be financed from the reserve fund is for the repair, physical public betterment or improvement or any preliminary studies and surveys relative thereto to any town structures or buildings.
  2. The Town Supervisor is hereby directed to deposit moneys of this reserve fund in a separate bank account to be known as the “Mexico Building Repair Capital Reserve Fund”.
  3. The Town Supervisor is hereby directed to deposit and secure the moneys of this Reserve Fund in the manner provided by Section 10 of the General Municipal Law.  The Town Board may invest the moneys in the Reserve Fund in the manner provided by Section 11 of the General Municipal Law, and consistent with the Town’s investment policy.  Any interest earned or capital gains realized on the moneys so deposited or invested shall accrue to and become part of the Reserve Fund.  The Town Supervisor shall account for the Reserve Fund in a manner, which maintains the separate identity of the cash and investments of the Reserve Fund.
  4. Except as otherwise provided by Section 6-c of the General Municipal Law, expenditures from this Reserve Fund shall be made only for the purpose for which the Reserve Fund is established.  No expenditures shall be made from the Reserve Fund without the approval of the Town Board and are subject to permissive referendum if required by Section 6-c of the General Municipal Law.

Resolution 2014-89 Cable Audit
     A motion was made by Councilor Behling and seconded by Councilor Partrick to accept the following resolution. The motion was adopted by 5 ayes; Anderson, Greenway, Behling, Barber, Partrick and 0 nays.
Resolved the Mexico Town Board appointed Cohen Law Group to do the cable audit.

Resolution 2014-90 Museum Repairs
     A motion was made by Councilor Barber and seconded by Councilor Greenway to accept the following resolution. The motion was adopted by 5 ayes; Anderson, Greenway, Behling, Barber, Partrick and 0 nays.
Resolved the Mexico Town Board approves the proposal by Daniel Manning in the amount of $2,000 to prepare the drawings for the repair to the museum.

Resolution 2014-91 Operation Reindeer Proclamation
     A motion was made by Councilor Greenway and seconded by Councilor Behling­­_ to accept the following resolution. The motion was adopted by 5 ayes; Anderson, Greenway, Behling, Barber, Partrick and 0 nays.
Resolved the Mexico Town Board approves the following proclamation:
Whereas, Christmas is a time for our community to show a spirit of caring for all citizens, and
Whereas, Operation Reindeer has displayed this spirit of giving by distributing toys to needy children, and
Whereas, The spirit of giving by Operation Reindeer is an important part of our holiday season,
Now Therefore, I, David Anderson, Supervisor of the Town of Mexico, do hereby declare that November and December shall be proclaimed as Operation Reindeer Months in the Town of Mexico and do hereby urge all our citizens to participate in this most worthwhile endeavor by making donations to this worthy cause.

A motion was made by Councilor Greenway and seconded by Supervisor Anderson to go into executive session at 8:07 to discuss litigation.  The motion was adopted by 5 ayes; Anderson, Greenway, Behling, Barber, Partrick and 0 nays.
A motion was made by Councilor Greenway and seconded by Councilor Partrick to come out of executive session at 8:17.  The motion was adopted by 5 ayes; Anderson, Greenway, Behling, Barber, Partrick and 0 nays.

Resolution 2014-92 Tops Settlement
     A motion was made by Councilor Greenway and seconded by Councilor Partrick to accept the following resolution. The motion was adopted by 5 ayes; Anderson, Greenway, Behling, Barber, Partrick and 0 Nays.
Resolved the Mexico Town Board approves the Tops Evaluation Settlement.

There was a discussion about Blunt Drive, donation of property to expand Wellwood Cemetery and zoning.

Resolution 2015 -93 Audit of Claims
     On motion by Councilor Behling and seconded by Councilor Greenway the following resolution was adopted by 5 ayes, Anderson, Greenway, Behling, Barber, Partrick and 0 nays.
Resolved that the bills for Abstract 10 have been reviewed by the Town Board and are authorized for payment in the following amounts with a correction to voucher #200 in “D”.
