Minutes of the Regular Meeting

Held October 8, 2018 at the Town Hall Commencing at 7:30 P.M.

Supervisor Anderson opened the regular Town Board meeting at 7:33 with the Pledge of Allegiance.

Resolution 2018-85 Approval of Minutes

A motion was made by Councilor Partrick and seconded by Councilor Behling to accept the following resolution. The motion was adopted by a vote of 4 ayes Anderson, Behling, Greenway, Partrick and 0 nays.

Resolved the Mexico Town Board approves the minutes from the September 10, 2018 town board meeting.

Public Comment and Concerns:  Nancy Weber spoke about economic development for the Town of Mexico.

Reports:

Town Clerk – A motion was made by Councilor Greenway and seconded by Councilor Behling to accept the town clerk report as presented.  The motion was adopted by a vote of 4 ayes Anderson, Behling, Greenway, Partrick and 0 nays.

Dog Control Officer– A motion was made by Councilor Greenway and seconded by Councilor Partrick to accept the dog control report as presented.  The motion was adopted by a vote of 4 ayes Anderson, Behling, Greenway, Partrick and 0 nays.

Zoning Officer / Building Inspector – A motion was made by Councilor Behling and seconded by Councilor Greenway to accept the monthly report as presented.  The motion was adopted by a vote of 4 ayes Anderson, Behling, Greenway, Partrick and 0 nays.

Highway Superintendent – A motion was made by Councilor Greenway and seconded by Councilor Behling to accept the monthly report as presented.  The motion was adopted by a vote of 4 ayes Anderson, Behling, Greenway, Partrick and 0 nays.

Community Park – none

Mexico Point Park – Diane Chepko-Sade said she had a copy of the proposed budget for Mexico Point Park.  There was a question as to why the gate is closed. Dick Salley had questions about the repairs to the roof on Casey’s Cottage.   A motion was made by Councilor Behling and seconded by Councilor Greenway to accept the monthly report as presented.  The motion was adopted by a vote of 4 ayes Anderson, Behling, Greenway, Partrick and 0 nays.

Water Commissioner –none

Supervisor A motion was made by Councilor Partrick and seconded by Councilor Behling to approve the supervisor’s report as presented.  The motion was adopted by a vote of 4 ayes Anderson, Behling, Greenway, Partrick and 0 nays.

Anderson said Attorney Shanley contacted him about a water account.  Dishaw said Shanley also contacted her and she directed him to Anderson.  Dishaw said the account has been in arrears since 2017.  The town board made the decision in April that the bill should be paid.  Anderson said if the bill is not paid it should be turned off and she should relevy it onto the tax bill the same as other unpaid water bills.

Resolution 2018- 86 Mexico Point Park Gate

A motion was made by Councilor Partrick and seconded by Supervisor Anderson to accept the following resolution.  The motion was adopted by a vote of 4 ayes, Anderson, Greenway, Behling, Partrick, and 0 nays.

Resolved the Mexico Town Board approves to keep the chain off the park during the day and put the chain across the entrance to the parking lot at dusk.

Resolution 2018- 87 September Payroll

A motion was made by Councilor Greenway and seconded by Councilor Behling to accept the following resolution.  The motion was adopted by a vote of 4 ayes, Anderson, Greenway, Behling, Partrick, and 0 nays.

Resolved the Mexico Town Board approves the September payroll.

 Water Update – Yerdon said the bid for construction for WSA#5 should be ready in December or January with construction to start in the spring of 2019. The billing for WSA #5’s debt service will appear on taxes in 2020.  Greenway asked how many questionnaires have been returned undeliverable.  Yerdon said he would follow up and let the town board know.  Greenway asked what the EDU charge for the old schoolhouse on Lamb’s Corner would be.  Yerdon said there has been discussion on EDU charge for the resident on Hurlbut Road that is in the New Haven water district.  Anderson said he had a meeting with the supervisor of New Haven and it was decided that no maintenance fee would be charged for New Haven’s water district #8, the EDU charge for Hurlbut Road would go to Mexico and EDU charge for Green Road would go to New Haven.  Yerdon said New Haven Supervisor Teifke told him he did not remember such an agreement.  The discussion continued about the water agreement.

Greenway had question about Parish’s fee schedule for EDU’s.  Yerdon said he didn’t know he doesn’t represent Parish.  Greenway said Parish is not charging one EDU for residences if they do not hook up but will charge one half an EDU.  Yerdon said the funding agency would have a say in the EDU charges.

A motion was made by Councilor Greenway and seconded by Councilor Partrick to approve the water update as presented.  The motion was adopted by a vote of 4 ayes Anderson, Behling, Greenway, Partrick and 0 nays.

Anderson said this year’s budget was difficult but is under the tax cap.  There are some adjusts to make. Adjustments to sewer units must be made.  Retirement went down.  Positions for water clerk and to wind the clock were made.  A new truck was purchased and we no longer have the county snow plowing contract.  The EDU charges may have to be increased in the near future to cover repairs for water district #1.  Partrick asked if the town were allowed to adjust the EDUs.  Nelson said only the first year is fixed.

Town Clock:

Anderson said Lang Clock and Vintage Repair will not be available until November 1st.  There is a problem with one of the sprocket slides.  If Lang is still unavailable he suggested contacting the Amish on Cole Road.  Lang said he would train George Monson and Gary McConnell to wind the clock.

Beginning January 1, 2019 towns are required to conduct annual sexual harassment prevention training.

The 3rd Quarterly Report has an error on Capital Reserve Fund.

The Community Park Lease Agreement is due.

NYMIR made recommendations at the last inspection.  They are requesting confirmation that all request were complied with.  Anderson said he would follow up with everyone.

Park Manager:

Anderson said he has worked with the Friends of Casey’s Cottage to create a lease.  The amendments are as follows:

  1. There will be a yearly evaluation
  2. An unusual Event Reporting Form is to be completed
  3. An Employee Incident Report is to be completed

A motion was made by Councilor Behling and seconded by Councilor Greenway to table the decision on the lease with Friends of Casey’s Cottage.  The motion was adopted by a vote of 4 ayes, Anderson, Greenway, Behling, Partrick, and 0 nays.

Resolution 2018-88 Court Audit

A motion was made by Councilor Greenway and seconded by Councilor Partrick to accept the following resolution.  The motion was adopted by a vote of 4 ayes Anderson, Behling, Greenway, Partrick and 0 nays.

Resolved the Mexico Town Board approves the 2016 and 2017 Court Audits.

Resolution 2018-89 2015 Ford Truck BAN

A motion was made by Councilor Greenway and seconded by Councilor Behling to approve the following resolution.  The motion was adopted by a vote of 4 ayes Anderson, Behling, Greenway, Partrick and 0 nays.

Resolved the Mexico Town Board approves the payment of $5,160 plus interest for the 2015 Ford truck and to BAN for the balance.

Resolution 2018-90 Economic Development

A motion was made by Councilor Greenway and seconded by Councilor Behling to approve the following resolution.  The motion was adopted by a vote of 4 ayes Anderson, Behling, Greenway, Partrick and 0 nays.

Resolved the Mexico Town Board authorizes Nancy Weber to contact IDA and Mike Treadway to discuss economic development in the Town of Mexico.

 Resolution 2018 91 Audit of Claims 

A motion was made by Councilor Greenway and seconded by Council Partrick to accept the following resolution.  The motion was adopted by a vote of 4 ayes Anderson, Behling, Greenway, Partrick and 0 nays.

Resolved that the bills for Abstract 10 have been reviewed by the Town Board and are authorized for payment in the following amounts:

General A Fund                      voucher # 253 to 279              $    43,258.64

General B Fund                      voucher # 78 to 86                  $      5,224.60

Highway Fund                        voucher # 224 to 245              $    35,383.74

Water                                      voucher # 18 to 19                  $      2,293.75

Special Districts                      voucher # 15 to 16                  $      1,022.17

            Resolution 2018- 92 Schedule Public Hearing for Budget, Fire and Ambulance

A motion was made by Supervisor Anderson and seconded by Councilor Greenway to accept the following resolution. The motion was adopted by 4 ayes; Anderson, Greenway, Behling, Partrick and 0 Nays.

Resolved the Mexico Town Board scheduled a Public Hearing for November 8, 2018 at 7:00 pm for the Budget, 7:10 pm for the Fire Contract, and 7:20 pm for the Ambulance Contract at the Town Hall, 64 South Jefferson Street, Mexico, New York 13114.

A motion was made by Councilor Greenway and seconded by Councilor Behling at 9:20 to adjourn.  The motion was adopted by a vote of 4 ayes Anderson, Behling, Greenway, Partrick and 0 nays.
