Supervisor Anderson opened the regular Town Board meeting at 7:32 with the Pledge of Allegiance.
Resolution 2014-72 Approval of Minutes
On motion by Councilor Greenway and seconded by Councilor Behling the following resolution was adopted by a vote of 4 ayes, Anderson, Greenway, Behling , Barber and 0 Nays
Resolved the Mexico Town Board approves the minutes from the July 13 and July 28, 2015 town board meeting.

Town Clerk – A motion was made by Councilor Behling and seconded by Councilor Barber to accept the town clerk reports as presented. The motion was unanimously adopted by 4 ayes Anderson, Greenway, Behling, Barber, and 0 nays.
Dog Control Officer- A motion was made by Councilor Behling and seconded by Councilor Greenway to accept the monthly report as presented. The motion was adopted by 4 Ayes; Anderson, Greenway, Behling, Barber and 0 Nays
Zoning Officer / Building Inspector – A motion was made by Councilor Behling and seconded by Councilor Greenway to accept the monthly report as read. The motion was adopted by 4 Ayes; Anderson, Greenway, Behling, Barber and 0 Nays
Highway Superintendent – A motion was made by Councilor Behling and seconded by Councilor Barber to accept the monthly report as read The motion was adopted by 4 Ayes; Anderson, Greenway, Behling, Barber and 0 Nays
Mexico Point Park – Councilor Behling said he noticed some damage to the statues and there was a lot of trash on the beach.
Community Park – none
Supervisor –A motion was made by Councilor Greenway and seconded by Councilor Behling to approve the monthly report as presented. The motion was adopted by 4 Ayes; Anderson, Greenway, Behling, Barber and 0 Nays.
Resolution 2014-73 Payroll
On a motion by Councilor Greenway and seconded by Councilor Behling the following resolution was adopted by 4 Ayes; Anderson, Greenway, Behling, Barber and 0 Nays.
Resolved the Mexico Town Board approves the July payroll.
Resolution 2014-74 Resolution to Submit Final Application for Water District #3
On a motion was made by Councilor Barber and seconded by Councilor Greenway the following resolution was adopted by 4 Ayes; Anderson, Greenway, Behling, Barber and 0 Nays.
WHEREAS. The Town Board of Mexico has been asked to consider the formation of the Water Service Area #3 in the Town of Mexico, pursuant to Article 12-C of the Town Law; and
WHEREAS, the Town Board directed that C2AE, prepare a Map, Plan and Report to further consider all aspects of the proposed extension; and
WHEREAS, at a special meeting of the Town Board held the 11th day of May, 2015, the Town Board reviewed the Map, Plan and Report and directed the Town Clerk to publish the Order and Notice of Public Hearing scheduled for May 27, 2015, in the official newspaper for the Town, Independent Mirror, and posted on the Town bulletin board pursuant to Article 12-C of the Town Law.
WHEREAS, at a special meeting of the Town Board held the 27th day of May, 2015, the Town Board, after full discussion, deemed that the Notice of Hearing was published and posted as required by law and was otherwise sufficient; deemed it in the best interest of the Town to form the water service area as outlined in the Map, Plan and Report prepared by C2AE, determined that all the property and property owners within the proposed water service area would benefit from the water service formation, determined that all the property and property owners that would benefit from the proposed water service are included within the boundaries of the proposed water service area, determined that establishment of the water service area is in the public interest and thereby determined to hold a referendum on July 27, 2015, to allow eligible property owners the opportunity to vote on whether to form the water service area, as outlined in the said map, Plan and Report; and
WHEREAS, the Town Clerk having given notice of the referendum and said referendum having been held on July 27, 2015 from 12 p.m. until 7 p.m. and said referendum to establish the Town of Mexico Water Service Area #3 having been approved by a majority of the owners of taxable real property situated in the proposed water service area as shown on the latest completed assessment roll of the Town, voting thereon; and
WHEREAS, pursuant to Article 12-C of the Town Law, the approval of the State Comptroller is required to the Town Board’s issuance of an Order to establish Water Service Area #3 of the Town of Mexico, pursuant to the Town Law, and the State Comptroller requires the submission of an Application approved by the Town Board in order to approve the water service area formation.
THEREFORE;
1. The attached application was prepared at the direction of the Town Board.
2. The Town Board believes the contents of the Application to be accurate and hereby approves the Application.
3. The Water Service Area #3 of the Town of Mexico is in the public interest and will not constitute and undue burden on the property, which will bear the cost therefore.
4. The cost of the Water Service Area #3 of the Town of Mexico is to be assessed against all the real property within the boundaries of the proposed water service area and no benefited property has been excluded from the water service area.
5. Town Supervisor, David Anderson, is hereby directed to execute and verify the Application
Resolution 2014-75 Water Service Agreement Between the Village of Mexico and Town of Mexico
On a motion by Councilor Behling and seconded by Councilor Barber the following resolution was adopted by 4 Ayes; Anderson, Greenway, Behling, Barber and 0 Nays.
Resolved the Mexico Town Board approves the Water Service Agreement between the Village of Mexico and Town of Mexico.
Councilor Greenway asked what the responsibility for the town was to repair water main breaks. Guminiak said the town is only responsible for the service line. Councilor Greenway said the leakage was in the addition line the town gave to the home owner. It was not installed properly. Guminiak said it was the home owner’s responsibility.
A motion was made by Councilor Behling and seconded by Councilor Greenway to table the proposal from the architect for the museum repairs until Barber reviews the damage. The motion was approved by 4 Ayes; Anderson, Greenway, Behling, Barber and 0 Nays.
Resolution 2014-76 Speed Limit on Mexico Point Drive
On a motion by Councilor Greenway and seconded by Councilor Behling the following resolution was adopted by 4 Ayes; Anderson, Greenway, Behling, Barber and 0 Nays.
Resolved the Mexico Town Board approves the request for a change in the speed limit on Mexico Point Drive from 55 mph to 35 or 40 mph.
Resolution 2014-77 – Auction Highway Equipment
On a motion by Councilor Behling and seconded by Councilor Greenway the following resolution was adopted by 4 Ayes; Anderson, Greenway, Behling, Barber and 0 Nays.
Resolved the Mexico Town Board authorizes Highway Superintendent Fortier to place the 1995 truck and excess highway equipment on Auctions International.
Greenway suggested hiring a spec writer instead of engineer drawings. Barber said he would talk to Dan Manning.
Resolution 2014-78 Audit of Claims
On motion by Councilor Behling and seconded by Councilor Greenway the following resolution was adopted by 4 ayes, Anderson, Greenway, Behling , Barber and 0 Nays.
Resolved that the bills for Abstract 8 have been reviewed by the Town Board and are authorized for payment in the following amounts:
General A Fund voucher # 203 to 233 $21,511.89
General B Fund voucher # 47 to 54 $10,023.27
Highway Fund voucher # 143 to164 $92,970.62
Special Districts voucher # 10 $324.84
Water voucher # 12 $850.00
A motion was made by Councilor Greenway and seconded by Councilor Behling to adjourn at 8:50. The motion was adopted by 4 Ayes; Anderson, Greenway, Behling, Barber and 0 Nays.
