REGULAR MEETING – 6:00 PM

Present:
Mayor Grimshaw, Trustees: Linerode, Hotchkiss, Harter and Emery, John Power, William Hamacher, George Monson, Brian Stump, Andy Salvagni (departed 6:33 pm) Amanda Magro (arrived 6:05 pm) and Attorney Graham Seiter

Mayor Grimshaw opened the public hearing at 6:00 pm to discuss proposed Local Law #2 of 2021 “Cannabis Law Section 131 opting out of licensing and establishing retail cannabis dispensaries and/or on-site cannabis consumption establishments within the Village of Mexico”. Mayor Grimshaw stated that due to the fact there are no specific guidelines at this time and the village has no local law enforcement he feels it’s the village’s best interest to opt out of allowing a retail dispensary.  Andy Salvagni said that he was just wondering why the village would opt out but what the mayor stated makes sense. Amanda Magro stated that she agreed with mayor and that the village should opt out at this time until there are specific guidelines.  Trustee Linerode stated that she felt the village residents are not aware of the cannabis law therefore it should be put up for a public vote. On motion of Trustee Hotchkiss, seconded Trustee Harter, all aye, the public hearing was closed at 6:07 pm.

Mayor Grimshaw called the regular meeting to order at 6:07 pm.

The Minutes of the Regular Meeting of May 5, 2021 were approved on motion of Trustee Hotchkiss, seconded by Trustee Harter, all aye. The Minutes of the Fiscal Year-End meeting of May 26, 2021 were approved on motion of Trustee Emery, seconded Trustee Harter, Trustee Hotchkiss and Linerode abstained.

On motion of Trustee Hotchkiss, seconded Trustee Emery, all aye, the board approved Local Law #2 of 2021.

RESOLUTION ADOPTING LOCAL LAW NO. 2 OF THE YEAR 2021

            WHEREAS, the Village Board of Trustees for the Village of Mexico is considering adopting a local law, pursuant to Cannabis Law Section 131, opting out of licensing and establishing retail cannabis dispensaries and/or on-site cannabis consumption establishments within the Village of Mexico; and

            WHEREAS, the Village Board of Trustees has proposed Local Law No. 2 of the year 2021, a local law, pursuant to Cannabis Law Section 131, opting out of licensing and establishing retail cannabis dispensaries and/or on-site cannabis consumption establishments within the Village of Mexico and held a public hearing regarding proposed Local Law No. 2 of the year 2021 on the 2nd day of June, 2021; and

            WHEREAS, the Village Board of Trustees heard comments in favor of the proposed local law from residents of the Village of Mexico; and

            WHEREAS, the Village Board of Trustees believes it would be in the best interest of the residents of the Village of Mexico to adopt Local Law No. 2 of the year 2021, a local law, pursuant to Cannabis Law Section 131, opting out of licensing and establishing retail cannabis dispensaries and/or on-site cannabis consumption establishments within the Village of Mexico

NOW, THEREFORE, on motion made by Trustee Hotchkiss, and seconded by Trustee Emery, BE IT RESOLVED AS FOLLOWS:

  1. That the Village Board of Trustees does hereby adopt proposed Local Law No. 2 of the year 2021, a local law, pursuant to Cannabis Law Section 131, opting out of licensing and establishing retail cannabis dispensaries and/or on-site cannabis consumption establishments within the Village of Mexico; and

2. That it be further resolved and ordered that the Village Clerk and Village Attorney file Local Law No. 2 of the year 2021 with the Secretary of State’s Office as required by law.

On motion of Trustee Harter, seconded Trustee Linerode, all aye, the board set the date for a public hearing on proposed local law #3 of 2021 “imposing a six-month moratorium regulating the harboring of farm animals within the Village of Mexico” for July 7, 2021 at 6:00 pm at 3236 Main Street, Mexico NY

On motion of Trustee Emery, seconded Trustee Harter, all aye, the board set the date for a public hearing on proposed Local Law #4 of 2021, “establishing new water rates by the Village of Mexico” to immediately follow the public hearing on proposed Local Law #3 of 2021.

Brian Stump from Buffalo Solar presented the board with additional information to consider a solar farm on a property owned by George Monson in the village.  Solar farms are not allowed in the village according to a local law therefore, he would like the board to reconsider a use variance proposal he submitted.

Amanda Magro, Chamber of Commerce President confirmed with the village administrator and the village board that on August 3, 2021 at 6:00 pm the chamber will hold their monthly meeting at the DPW facility and tour the WWTP along with the DPW garage.

The meeting adjourned at 7:05 pm on motion of Trustee Linerode, seconded Trustee Harter, all aye.
